Joseph J. Fraresso is a Partner of Bartko Pavia LLP and his practice focuses on representing clients in technology-related litigation including patent litigation, trade secret litigation, and commercial litigation. 

His background in electrical engineering and strong aptitude for technology enables him to gain a deep understanding of the technology at issue to favorably position cases for trial. Joe has significant experience in all aspects of litigation gained by litigating technology related cases in California and throughout the United States. He has been involved in litigation related to computer security, smartphones, software, wireless communications, semiconductors, targeted advertising, computer networks, pharmaceutical manufacturing, and automotive technology.

Joe also has significant experience litigating commercial claims involving breach of contract, fraud, breach of fiduciary duty, and related claims involving disputed asset sales, investment agreements, license agreements, and disputes between company founders.

  • ASML US, Inc. v. XTAL, Inc. (California Sup. Ct.) – Obtained $845 Million jury verdict and permanent injunction for Plaintiff ASML in semiconductor software trade secret misappropriation case.
  • Ericsson Inc. et al. v. Apple Inc. (E.D. Tex.) – Obtained favorable settlement for client Ericsson in patent dispute involving smartphone security, interface technology, and operating systems.
  • Vir2us, Inc. v. Invincea, Inc. (E.D. VA) – Obtained favorable settlement for client Vir2us in patent dispute related to next-generation computer security software.
  • MOSAID Technologies Inc. v. LSI Corp. et al. (D. Del.) – Obtained summary judgment of liability and favorable damages settlement for client MOSAID in breach of contract claim involving the acquisition of a patent portfolio.
  • MedioStream Inc. v. Microsoft Corp. et al. (N.D. Cal.) – Obtained favorable settlement with Microsoft for client MedioStream in patent dispute related to media authoring software included in the Windows operating system.
  • Uview Ultraviolet Systems Inc. v. Brasscorp Ltd. (Federal Court of Canada) – Second chair at trial in patent dispute involving automotive repair technology. Obtained an injunction for client Uview prohibiting sales of all products accused of infringement.
